HANDMADE & NON-HANDMADE POLICY

Selling Handmade Items

Handmade on Oleolekita is a spectrum. On one end, we have makers — sellers who are literally making their items with their own hands (or tools). On the other end, we have designers — sellers who design their items but rely entirely on outside assistance or another business to help physically produce them. Many handmade sellers fall in the middle of the spectrum because they are both making and designing their items.  Regardless of where you fall on this spectrum, you must be transparent about who is helping you and how your items are being made. Everything listed as handmade must be made and/or designed by you, the seller. 

Makers
A maker is a seller who is physically making the items listed for sale in their Oleolekita shop. A maker might design their items in addition to making them, or they might follow a pattern or template that they did not design. Regardless, makers must be creating their items with their own hands (or tools).

Designers
A designer is a seller who has come up with an original design, pattern, sketch, template, prototype, or plan to be produced by in-house shop members or a production partner. Simple customisation, such as selecting colours, shapes, or choosing from ready-made options is not considered design on Oleolekita.

Whatever category you may fall into, we will refer to you as Artist or Artisan.

 

Using Production Assistance

Artists/Artisans may work with production partners to help make handmade items in certain circumstances. Keep in mind that people come to Oleolekita to discover items that they might not find anywhere else. Your design and production process should lead to the creation of a unique item that would not exist without you, the designer.

We expect your production partner to produce items themselves in their own facilities. A contractor or agent who outsources production may not be used as a production partner. Examples of production services include, but are not limited to, printing, apparel printing, 3D-printing, casting, plating, engraving, cutting and sewing, and finishing.

We may reach out to you at any time with a more detailed enquiry about your business. Please be prepared to provide additional details about the origins of your business, your role in the design process, your production process, and your connection to your production partner, as well as what efforts your production partner has made to follow our ethical expectations. We understand that you may wish to keep the details of your design and business practices confidential. Please be assured that Oleolekita will not use the private information you provide us for any purpose other than reviewing your business to determine that you are in compliance with our policies.  We reserve the right to reject any production partnerships that aren't in the letter or spirit of this policy or our ethical expectations.

 

Being Transparent About Your Business

At Oleolekita, we value transparency. Transparency means that you honestly and accurately represent yourself, your items and your business. As a handmade seller, you agree to:

  1. Use your own words and photographs (not stock photos) to describe your items; and
  2. Respond to any enquiries from us in a timely manner. We may ask you how your items are made, what workspace, tools and equipment you use; and how you communicate and collaborate with the people who help you run your shop.

 

Remember: Our marketplace is built on trust. Providing false, inaccurate, or misleading information is prohibited. If we find that you’re not being open and honest with us, we may decide not to carry your products / items with you in the future.

 

FEE & PAYMENT POLICY

Types of Fees

Sellers may be required to pay the following types of fees. Please note that all fees are listed exclusive of any value - added tax (VAT) that may apply.

Listing Fees. 0%. You will not be charged any listing fee at the moment.

Transaction Fees. 20%.  When you make a sale through Oleolekita.com, you will be charged a transaction fee of 20% of the price you display for each listing.

Advertising and Promotional Fees. 0%. Oleolekita offers multiple services to help you advertise your listings and promote your shop, including our Facebook Page and Instagram Page.  You will not be charged any advertising and promotional fees at the moment.

Payment Processing Fees. 5%.  Oleolekita charges a payment processing fee of 5% for each transaction. Payment processing fees are deducted from the total sale made in each transaction.  This processing fee is the fee charged by our Payment Gateway once sales is made.

Delivery Fees. 0% - 10%. All deliveries done by Oleolekita (if opted by you) will have a 10% delivery fee. All deliveries done by you will have a 0% delivery fee.

Bank Transfer Fee. Depending on the receiving banks, the fee will be different.  This transfer fee is not charged by Oleolekita but charged by your bank and will be deducted directly from the transferred monies.  Please note once transfers is done, your received value may differs from the actual value we transferred.

Currency Conversion.  Oleolekita converts fees from MYR to your payment account currency at the market rate at the time the transaction fee is charged. Oleolekita recommends you to set all selling price in MYR. Currency conversion is handled automatically by our payment processing service and your receiving banks.

 

Fee Avoidance

Any action by a seller to avoid paying a fee is considered fee avoidance and is strictly prohibited by Oleolekita. A transaction initiated on Oleolekita may not be completed off of Oleolekita. The price stated in each listing description must be an accurate representation of the sale. Sellers may not alter the item's price after a sale for the purpose of avoiding Oleolekita transaction fees, misrepresent the item’s location, or use another user's account without permission.

 

Paying your Oleolekita Fees

Oleolekita will automatically deduct all fees when we transfer the sales monies to you once sales have been made.

Taxes

GST / SST / VAT .Depending on your location, Oleolekita may be required to apply tax/taxes on transaction made and remit it to the relevant tax authority. These taxes are collected on sellers located in countries where GST/SST/VAT is be applied.

 

Restricted Goods

  1. The restricted goods are as follows:-
  1. the goods which are not in or are not put into, the deliverable state at the designated pick up point;
  2. the goods are defective, perish, or become so damaged, or no longer correspond to the description as furnished by you or no longer fit for the purpose as per your Request;
  3. the goods are subject to charges and/or encumbrances in favour of any third party;
  4. the goods are offensive, threatening, indecent, obscene, explosive, unsafe, or which is likely to cause damage harm and threats to the national security and/or public interest;
  5. the goods are in sensitive nature in respect of ethnicity, race, religion, gender equality, birth of origin, public morality, or such nature which is likely to cause or incite any disharmony disturbance annoyance or hatred to individuals groups or the public; or
  6. the goods are illegal due to its state and/or for the purpose of its use, or for and/or upon delivery, or which is likely to infringe violate or breach of any Applicable Laws.

 

Your Content as Artists/Artisans

Content that you send to Oleolekita is your content (so let’s refer to it as “Your Content”).

  1. Responsibility for Your Product. You understand that you are solely responsible for Your Product. You represent that you have all necessary rights to your product and that you’re not infringing or violating any third party’s rights by posting it.

 

  1. Permission to Use Your Content. By giving us your content to be used in any way to market and sell your products, you grant Oleolekita a license to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help Oleolekita function and grow. That way, we won’t infringe any rights you have in Your Content and we can help promote it. For example, you acknowledge and agree Oleolekita may offer you or Oleolekita buyers promotions on the Site, from time to time, that may relate to your listings.

 

  1. Rights You Grant Oleolekita. By sending us Your Content, you grant Oleolekita a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content. This allows us to provide the Services and to promote Oleolekita, or the Services in general, in any formats and through any channels, including across any Oleolekita Services, our partners, or third-party website or advertising medium. You agree not to assert any moral rights or rights of publicity against us for using Your Content. You also recognise our legitimate interest in using it, in accordance with the scope of this license, to the extent Your Content contains any personal information.

 

  1. Reporting Unauthorised Content. Oleolekita has great respect for intellectual property rights, and is committed to following appropriate legal procedures to remove infringing content from the Services. If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please inform us. If Your Content is alleged to infringe another person’s intellectual property, we will take appropriate action, such as disabling it if we receive proper notice or terminating your account if you are found to be a repeat infringer. We’ll do not promise to notify you if any of that happens.

 

  1. Inappropriate, False, or Misleading Content. This should be common sense, but there are certain types of products we don’t want posted on Oleolekita’s Services (for legal reasons or otherwise).

 

PAYMENT POLICY

Oleolekita’s Rights and Responsibilities

Oleolekita Payments functionality may be made available, modified, or discontinued by us at any time without notice. As a security measure, we may impose transaction limits on buyers and sellers. For example, we may impose limits relating to the value of any transaction, deposit, or adjustment, or limits relating to the cumulative value of all transactions, deposits, or adjustments during a period of time. We may also impose limits related to the number of transactions per day or other period of time. We will not be liable to a seller: (a) if we do not proceed with a transaction, deposit, or adjustment that would exceed any limit established by us, or (b) if we permit a buyer to withdraw from a transaction.

Oleolekita may refuse service of Oleolekita Payments to anyone, for any reason, at any time.

Oleolekita reserves the right to decline transactions that we believe to be high risk, fraudulent, or in violation our Terms.

In the event that a buyer does not make payment for the purchase of a legitimate item sold using Oleolekita Payments (e.g., where the buyer used a stolen or unauthorised credit card), Oleolekita may not provide payment protection to the seller.

 

Online Payment

All transaction in Oleolekita webstore is done through a secure payment gateway; SenangPay and Touch N’ Go E-Wallet.  Buyers are able to pay using these methods :

      1. Credit card (Visa/Mastercard)
      2. Debit Card (Visa/Mastercard/Approved bank)
      3. Internet Banking (FPX)
      4. Touch N’ Go E-Wallet

Once payment is done, the webstore will send an automatic order to Oleolekita and we will contact you with the order.

 

Disputes

 Sellers agree to resolve any disputes directly with a buyer or with our assistance.  Please note that any disputes will need to be managed directly between Buyer and Seller.  In the event that a buyer submits a chargeback, Seller is responsible for any chargeback or any other charges incur.

 

Transfers / Deposits

All transfers to seller’s bank account will be made after 72 hours - 96 hours (working days only) from the transaction date. This is to give ample time for all buyers to remit any issue they have with the purchased items received in maximum 48 hours.  In some cases, deposits to a seller's bank accounts could be temporarily delayed by an issue at Oleolekita, Oleolekita’s third-party service providers, or a seller’s bank. We’ll do our best to communicate with any affected seller as soon as we can.  If we believe that a seller's actions may result in buyer disputes, chargebacks or other claims, then we may, in our sole discretion, put a hold, deposit delay, reserve on the seller’s payment.  A hold may be put on funds associated with a particular transaction if there is a dispute or investigation related to the order, for the shorter of:
(a) 180 days after the estimated delivery date, or (b) completion of any investigation regarding the seller’s actions.

Deposit delays are defined as the number of days between a sale and the day the net amount from the sale becomes available for deposit, provided the payment has been completed. A deposit delay may be between 0 and 180 days. A deposit delay is applied across all transactions for a seller and the number of days is reflected in each seller’s payment account.  We always work hard to avoid and minimise any delays. However, please note that Oleolekita is not obligated to refund any fees or reimburse any expenses due to holds or delayed deposits.

Recoupment

We reserve the right, in our sole discretion, to seek reimbursement from a seller in any of the following circumstances:

  1. we provide a refund to a buyer because a seller did not promptly deliver the goods or we otherwise determine;
  2. we discover erroneous or duplicate transactions related to a seller;
  3. we receive a chargeback from a buyer's credit card issuer or reversal of payment for the amount of a buyer's purchase from a seller;
  4. a seller does not act in accordance with Oleolekita’s policies.

 

We may obtain reimbursement of any amounts owed by a seller to Oleolekita by deducting from future payments owed to the seller, or seeking reimbursement from the seller by any other lawful means, including by using third-party collections services. You authorise us to use any or all of the foregoing methods to seek reimbursement.

 

Termination

Sellers may terminate this contract and their acceptance of this Term.  Oleolekita may also terminate or suspend a seller.  Upon termination, any non-disputed Available Funds will be deposited into a seller’s bank account. Oleolekita reserves the right, to set off against any payments to be made to the seller, an amount determined by us to be adequate to cover any anticipated chargebacks, refunds, adjustments or other amounts that might be paid to buyers in connection with purchases from the seller's payment account for a prospective 180-day period. At the end of the 180-day period following termination, we will disburse to the seller any amount not used to offset chargebacks, refunds, adjustments, or such other amounts paid to buyers, or seek reimbursement from the seller via any of the means authorised in this Policy for any additional amount required to offset chargebacks, refunds, adjustments, or other amounts paid to buyers, as applicable.

 

DELIVERY POLICY

Delivering Your Items

Sellers can opt to send their sold items to buyers temselves or you can have Oleolekita to send the purchased items to the buyers.  If you're using a delivery or fulfilment service as you opt for delivering the items yourselves, please keep in mind that you are ultimately responsible for making sure that your buyers receive their orders. In this case, you agree to:

    1. Accept all orders made from Oleolekita.com once order is received;
    2. Dispatch items promptly after they are sold. Prompt delivery means that you dispatch each item within the stipulated time described in each of your items’ description. If the lead time differs for any reason at all, you will have the buyers’ consent before updating Oleolekita regarding this changes;
    3. Comply with all local and international delivery and customs regulations;
    4. Dispatch to the address as described by the buyer;
    5. Informing Oleolekita of the dispatched items by giving Oleolekita the copy of the tracking number, consignment number, or shipping details. Oleolekita.com will update the buyer of the dispatched details.

In the unlikely event an order does not arrive, be prepared to provide valid proof of dispatch. Valid proof of dispatch must show that the item actually was dispatched and that it was sent to the address provided on Oleolekita. If a buyer does not receive their order, they may file a case against you. 

 

If you choose Oleolekita to send the purchased items on your behalf, you agree to

    1. Accept all orders made from Oleolekita.com once order is received;
    2. Dispatch items promptly to Oleolekita on your own cost.  Prompt delivery means that you dispatch each item within the stipulated time described in each of your items’ description. If the lead time differs for any reason at all, you will have the buyers’ consent before updating Oleolekita regarding this changes;
    3. Oleolekita will best-effort comply with all local and international delivery and customs regulations. You will need to supply us with all details we may require regarding the purchased items to enable us to send the items to the buyer;
    4. Oleolekita will dispatch to the address as described by the buyer;

 

Delivery Fees and Insurance

The cost of a delivery will depend on the origin, destination, weight, mail class, package type, and dimensions of the package. Please note that you can opt for having your items:

      1. Delivered by Oleolekita to the customers; If the delivery if done by Oleolekita, a delivery fee of 10% off the total purchased per receipt/delivery address will be charged.  This means that the items should be in our warehouse, ready to be sent.  All delivery fees and insurance will be covered by Oleolekita.  If somehow that the delivery fee and insurance cannot be covered by the total sum paid for the item, Oleolekita will charged the remaining balance to you.
      1. Delivered yourself to the customers; If delivery is done by you, no delivery fee is charged.  All delivery fees and insurance will be borne by the seller.

 

Delivery Packaging

Regardless of whether the purchased items are sent by Oleolekita or by the seller, note that the purchased items may be handled multiple times, may pass through multiple sorting depot and may be shipped with other items.  All items should be sufficiently packaged so that it will reach the customers in  good condition.

 

RETURN, REFUND & EXCHANGE POLICY

All products sold in the webstore may have a different return, refund and exchange policy.  It is best for a seller to familiarise themselves with these policies and inform Oleolekita if you need an amendment or additional security blanket on each item.

 This yellow logo indicates that the item is possible for Return & Refund or Return & Exchange.  If your item uses this logo, note that the buyer has the rights for return, refund or exchange if something goes wrong with the purchased items.   

If the item has the red icon, that means that the item is not possible for Return & Refund or Return & Exchange.  All items with this icon are handmade thus refund and exchange are not possible.  All items with this icon are sold AS IS and the art pieces may differ slightly in colour, design and size.

Application For Return, Refurd & Exchange

Buyer may only apply for the return, refund or exchange of the purchased item in the following circumstances:

  1. The item has not been received by the buyer after delivery has been made.  Please note that every item may have different lead and delivery time.  You may check your item status with our third delivery services;
  2. The item was defective and/or damaged on delivery.  In this case, please let us know about it through Facebook Messenger m.me/oleolekita and send us the clear pictures of the packaging and clear pictures of the defects or damages of the item.  Please note that if the item is damaged or used by the you, there will not be any return, refund or exchange;
  3. The item does not match the agreed specification.  Send us message through Facebook Messenger m.me/oleolekita and cite issue;

Oleolekita.com will review each Buyer’s application on a case-by-case basis and, in its sole discretion, determine whether Buyer’s application is successful.

Condition Of Returning Items

  1. All items and its accessories must be returned to Oleolekita.com in the condition received on delivery. We will recommend you to take a photo of the item upon receipt, and clear pictures of the packaging and the item itself.  The item should be returned in its original packaging and shipping container.
  2. Application for returning item should be made in 48 hours after receiving.  You can just simply message us through Facebook Messenger m.me/oleolekita and cite us your issue.
  3. Return the item to Oleolekita.com either by using your own third-party courier service company or our third-party courier service company.  Please note that if you are using your own third-party courier service, the cost of returning the item to Oleolekita.com is borne fully by you. Else, we will send our third-party courier service company to pick-up the item from the same delivery address and the cost of delivery is fully borne by Oleolekita.com and/or our vendors.

If the buyer select Pickup From Store during checkout, Oleolekita.com will not cover the returning cost of all items if the buyer chooses to return the item later. 

 

Refund Or Exchange

After inspecting all documents (receipts and pictures) Oleolekita.com or our vendors have the right to do either one of the following:-

  1. Buyer will only be refunded after Oleolekita.com received the returned item with investigation process and procedures completed. The refund will be made to the buyer credit/debit card or designated bank account, whichever is applicable.  Please note that it may take 30 days to refund the monies to the buyer.
  2. Exchange the same item or another item with the same or higher value.

 

PRIVACY POLICY

At Oleolekita, we care deeply about privacy. We believe in transparency, and we’re committed to being upfront about our privacy practices, including how we treat your personal information. We know you care about your privacy too, so we provide settings that allow you to choose how certain information is used by Oleolekita. This policy explains our privacy practices for Oleolekita.com (which we’ll refer to as the "Site"), Oleolekita Payments, Oleolekita’s public Application Programme Interface (the “API”), and our other services provided by Oleolekita.  We'll refer to the Site, Oleolekita Payments, the API, and our other services as the "Services". This policy does not apply to the practices of third parties.

 

Our Privacy Policy

We process your personal information to run our business and provide our users with the Services. By accepting our Terms and Conditions, you confirm that you have read and understand this policy, including how and why we use your information. If you don’t want us to collect or process your personal information in the ways described in this policy, you shouldn’t use the Services.

By using the Services, you acknowledge that Oleolekita will use your information to grow enable us to send the items you bought and to grow the business. Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside.

 

Information Collected or Received

In the course of providing our Services, we collect or receive your personal information in a few different ways. We obtain the categories of personal information listed below from the following sources: directly from you, from forms you complete or during registration; indirectly from you based on your activity and interaction with our Services, or from the device or browser you use to access the Services; from our artists/artisans that help provide Oleolekita services you may interact with, and from our third party advertising and marketing partners. Often, you choose what information to provide, but sometimes we require certain information to provide you the Services. Oleolekita uses the personal information it receives and collects in accordance with the purposes described in this policy.

You can also choose to provide information to a third party via Oleolekita’s API. While users of Oleolekita’s API are required to follow Oleolekita’s API, including having appropriate privacy and security controls, Oleolekita does not have a direct partner relationship with these third parties and their processing of information is subject to their own privacy policies. You should understand the privacy and security practices of any third party before you share information with them.

Registration, Account Setup, Service Usage: In order to use the Services, you will need to submit a valid personal details. If you register, you will need to submit a name associated with your account. You need to provide this information to enable us to provide you with the Services. Additional information, such as billing and payment information (including billing contact name, address, telephone number, credit card information), a telephone number, and/or a physical postal address, may be necessary in order for us to provide a particular service. For example, we need a physical postal address if you are buying something on the Site for delivery.

 

As an Oleolekita artist/artisans, if you choose to use our service, Oleolekita requires your full name, bank account information, credit card information, and/or other proof of identification in order to verify your identity, provide this service to you, and comply with applicable law. For both buyers and artists/artisans, Oleolekita requires this information from you in order to provide you with the Services.  We may store credit card information for both billing and payment purposes. To authenticate a payment, you will need to respond to a prompt from your card issuer and provide additional information, such as a correct response to a question, a password, or a passcode.  In order to use certain products or services on Oleolekita, you may be required to complete an application; information that you submit through the application process will not be displayed publicly and will only be used internally by Oleolekita and its service providers, unless otherwise specified.

 

Profile: You may provide your name and other personal information (such as birthday, gender, location) in connection with your account and activity.

 

Automated Information: Oleolekita automatically receives and records information from your browser or your mobile device when you visit the Site, or use certain features of the Services, such as your IP address or unique device identifier, cookies, and data about which pages you visit and how you interact with those pages in order to allow us to operate and provide the Services. This information is stored in log files and is collected automatically. Oleolekita may also receive similar information (like, for example, IP addresses and actions taken on the device) provided by a connected Internet of Things device such as a voice-activated assistant or Smart TV. We may combine this information from your browser or your mobile device with other information that we or our advertising or marketing partners collect about you, including across devices. This information is used to prevent fraud and to keep the Services secure, to analyse and understand how the Services work for members and visitors, and to provide advertising, including across your devices, and a more personalised experience for members and visitors.

 

Data from Oleolekita Vendors: We also receive information from our artists/artisans about you. This information can include customer service interactions, payments information, delivery information, and information.

 

Messages from Oleolekita

On occasion, Oleolekita will need to contact you. Primarily, these messages are delivered by email for a variety of reasons, including marketing, transactions, and service update purposes. Every account is required to keep a valid email address on file to receive messages. Oleolekita may also contact you by telephone to provide member support or for transaction-related purposes. Additionally, and with your consent where required by applicable law, Oleolekita may send you an SMS (or similar) message, or reach out to you by telephone, in order to provide you with customer support, for research or feedback, or to provide you with information about products and features that you may find of interest.

Information Uses, Sharing, & DiSclosure

We respect your privacy. Oleolekita will not disclose your name, email address or other personal information to third parties without your consent, except as specified in this policy.

Legal Bases. When you access or use the Services, we collect, use, share, and otherwise process your personal information for the purposes described in this policy. We rely on a number of legal bases to use your information in these ways. These legal bases include where:

  1. Necessary to perform the contractual obligations in our Terms of Use and in order to provide the Services to you;
  2. You have consented to the processing;
  3. Necessary to comply with a legal or regulatory obligation, a court order, or to exercise or defend any impending or asserted legal claims;
  4. Necessary for the purposes of our or a third party’s legitimate interests;
  5. You have expressly made the information public; and
  6. Necessary in the public interest, such as to prevent crime;

 

Where we process your information on the basis of legitimate interests, we do so as follows:

Providing and Improving our Services: We use your information to improve and customise our Services, including sharing your information for such purposes, and we do so as it is necessary to pursue our legitimate interests of improving our Services for our users.

 

Providing Marketing Communications: We rely on our legitimate interest to send you marketing messages (where permitted independent of consent) and for Oleolekita's advertising programmes (including Oleolekita’s on-site advertising and marketing).

 

Keeping our Services Safe and Secure: We use your information for safety and security purposes, which can include sharing your information for such purposes. We use your information to provide and improve the Services, for billing and payments, for identification and authentication, and for general research and aggregate reporting.

 

Buying and SellingAs part of the buying and selling process, Oleolekita will facilitate the sharing of information between the two members involved in the transaction, such as the other Oleolekita buyers’ delivery address and payment status. This can also involve us sharing your information with some of our third party partners such as our delivery and payment partners to enable us to provide the Service to you. Such partners will process your personal information in accordance with their own privacy policies. By making a sale or a purchase on Oleolekita, you are directing us to share your information in this way. Since this is an important part of the Services we provide, we need to do this in order to perform our obligations under our Terms of Use. We expect you to respect the privacy of the member whose information you have received.
